FULTON COUNTY, Ga. — The man accused of murdering a 44-year-old father, poet and musician on his way to his niece's funeral at a south Fulton County gas station in 2016 has been convicted, officials say.
Brian Duffy, 27, has been found guilty of murder, attempted armed robbery, aggravated assault with a deadly weapon, entering auto, and several other charges, the Fulton County District Attorney says.
On Oct. 6, 2016, officials say Kenneth Oglesby, 44, stopped to get gas and lunch at a Chevron station on Roosevelt Highway, near where he lived, before heading to his niece’s funeral in Ohio. That's when surveillance video showed a vehicle pulling up to the pump where he stood.
The video showed Duffy getting out of the car wearing a black "Scream" mask and aiming his gun at Oglesby in an attempt to rob him. Oglesby dropped the cell phone he had in his hand and backed up with his arms in the air, but Duffy fired one shot with a 9mm handgun, hitting Oglesby in the neck.
Duffy then got back into his car and left the scene. Hours later, Fulton County Police spotted him as he drove along Buffington Road and tried to pull him over. However, sped off, weaving in and out of traffic.
Police chased Duffy until he lost control of his car and crashed into a utility pole. He tried to run away from police, but officers were able to track him down and take him into custody.
Investigators recovered Duffy's cellphone when he was arrested. On it, investigators found a video retrieved that showed him, hours earlier, in the front seat of the getaway car waving around the same gun police say he used to kill Oglesby. Duffy was also wearing the same clothes and “Scream” mask he wore during the murder.
Duffy will be sentenced at a later date.
