Fugitive taken to hospital after being shot by US Marshals was wanted for murder: GBI

The shooting happened at the intersection of Rockbridge Road SW and South Indian Creek Drive in DeKalb County, the GBI said.

ATLANTA — The search for an out-of-state murder suspect led by the U.S. Marshals Service ended in gunfire on Tuesday afternoon. 

The Georgia Bureau of Investigation is investigating a shooting involving law enforcement that happened at the intersection of Rockbridge Road SW and South Indian Creek Drive in DeKalb County. The Fulton County Sheriff's Office asked the GBI to conduct the investigation. 

According to the GBI, around 1:15 p.m., U.S. Marshals Service Fugitive Task Force Officers were searching for a fugitive wanted on outstanding warrants for murder and weapons charges in another state.

Deputies found the suspect, 32-year-old Kevin Barton of Massachusetts, and attempted to arrest him, the GBI said. Barton was wanted by the Fall River Police Department in Massachusetts.

Preliminary information indicates that Barton ran from deputies, and while running away, he allegedly pulled a gun from his clothing and raised it toward a deputy. The GBI said that a deputy fired his gun -- hitting Barton. The deputy involved was part of the U.S. Marshals task force. 

Barton was taken to the hospital and is in stable condition, the GBI said. No officers or deputies were injured in this incident. 

The DeKalb County Police Department is taking on any additional charges against Barton related to this incident while the GBI is conducting an investigation into the shooting. Once complete, the case file will be given to the DeKalb County District Attorney's Office for review.
