Judge rules DA Fani Willis doesn't need emergency injunction in fight against subpoena because hearing already happened

It was a largely procedural order from Judge Shukura Ingram.

ATLANTA — A judge denied an emergency petition by Fulton County District Attorney Fani Willis filed to stop the Georgia Senate Committee on Special Investigations from enforcing two subpoenas.

The move was largely procedural, as Fulton County Superior Judge Shukura Ingram noted the emergency request was for an injunction related to subpoenas for the Sept. 13 meeting of the committee -- and, with Sept. 13 having passed, the injunction was no longer necessary.

"As an initial matter... the time for the production commanded in the subpoenas in question has passed," Judge Ingram's order stated. 

It added that the committee had also "not taken action to enforce the subpoenas."

"As such, this is no longer an emergency," the order states.

The judge's order does not settle the merits of whether DA Willis actually can or cannot be compelled by the Georgia Senate to comply with a subpoena.

That, the judge's order notes, would be settled by a motion to quash the subpoenas -- essentially, throw them out -- and not by a motion for an emergency injunction. Ingram also notes that to this point, the Georgia Senate has not asked the court to compel compliance, which would similarly force the matter.
