HENRY COUNTY, Ga. — A Henry County grand jury indicted a former cop Thursday on charges of violating his duty as a law enforcement officer.
Former Henry County Police Officer David Rose was formally charged with two counts of violation of oath by a public officer, and one count of simple battery, false official writings, and making a false statement.
On Dec. 2, 2017, Rose was working as a patrol officer when he responded to a report of aggressive driving in the parking lot of Target on Jonesboro Road in McDonough, according to the report.
During the traffic stop, video captures Rose was seen choking former NFL player Desmond Marrow while Marrow was on the ground and handcuffed from behind. The incident, as well as statements by Rose concerning the incident, were captured on video.
Rose told a different version of the encounter in his police report. Rose, a Henry County officer for three years, was subsequently terminated.
The District Attorney’s Office presented the case to the Grand Jury after Rose rejected a plea offer to a single misdemeanor charge with a sentence of probation and surrendering his police certification.
