ATLANTA — On Day 9 of the Tex McIver murder trial, testimony revolved around the belongings left behind after Diane McIver was shot and killed.
Tex McIver is accused of intentionally killing his wife, Diane, on Sept. 25, 2016. She died died after being shot in the back with a handgun while in the passenger's seat of an SUV. Tex was riding behind Diane and had a loaded revolver in his lap and, according to him, the revolver fired on its own. He claims that the shooting was "a horrible accident."
McIver faces murder, felony murder, aggravated assault with a deadly weapon, possession of a firearm during a felony and three counts of influencing witnesses related to the case.
On Friday, the jury was shown a photo that shows a picture of Diane’s belongings. However, it was not her belongings from her closet but an estate sale that happened just months after Tex shot Diane. He held the estate sale in early December 2016, which netted nearly $68,000 for Tex, after the estate sale company took their commission.

An auction happened a month later between Jan. 14 and 17, 2017. Those items auctioned off were more valuable in nature than the estate sale, and included things like fur coats and expensive jewelry. The auction netted around $119,000 for Tex. Combined, the estate sale and auction brought in about $187,000 for Tex.

Another issue for the trial is the schedule. Jurors were told the trial would be over by the end of the month, but both sides think it will last at least another week. However, the first week of April is spring break for all metro schools and many of jurors have conflicts. So, they will take that week off and then continue in the second week of April.
