Man shot during filming of Lil Baby music video in Atlanta files lawsuit, alleging inadequate security

Kevin Mares was shot on the set of the music video being filmed at shopping center, the suit states. He does not place the security responsibility on the rapper.

ATLANTA — Nearly five months after three men were shot on the set of a music video being filmed with Atlanta rapper Lil Baby, one of the victims has filed a lawsuit in Fulton County. 

On Friday, Oct. 11, Kevin Mares filed a lawsuit in Fulton County, naming the companies behind the production, security and location of the video as defendants.

The shooting happened on May 14 in a shopping plaza at 2179 Verbena Street NW in the Dixie Hills neighborhood.

Multiple 911 calls were made from the set of the music video and also from people living across the street who heard the gunfire. In one of the 911 calls released Monday, you could hear gunshots still being fired in the background as witnesses were trying to get help for those victims who had been injured.

In another 911 call, you hear the dispatcher ask, 'What's your name?" to which the person on the other end of the phone, in a faint voice, responds, "Kevin." The audio is hard to make out, but he mentions something about his breathing and then relayed to the dispatcher he'd been shot in the neck. 

According to the suit filed, we now know that Mares was one of the people injured that day. Some of the defendants listed include Shotclock based out of Brooklyn, New York and Quality Control Music based out of Roswell, Georgia. 

The lawsuit alleges that "Defendants Shotclock and Quality Control agreed verbally and in writing to hire well-trained, capitalized and insured professional security, which they negligently failed to do. As part of the security responsibility, Defendants agreed to not allow subcontracting without specific approval, also which Defendants negligently failed to enforce and perform." 

The two security companies named as defendants are Cannon Executive Protection Agency and Tactical Elite Protection Services, which have companies in metro Atlanta. 

The lawsuit also listed Bristol Consulting Group as the defendant, stating the company "owned, operated, controlled and/or managed the property where the video shoot and incident took place." 

The lawsuit alleges that the defendants negligently handled the pre-production planning as well as any onsite needs and responsibilities. It argues that the negligence led to Mares' injuries. 

"Defendants’ negligence includes their failure to provide any security personnel at the property at the time of the subject shooting," according to the lawsuit. 

It's not mentioned what kind of work Mares was doing on the set at the time he was shot. 

In the lawsuit, it's specifically stated that Mares does not place any of the security responsibility on the Atlanta based rapper. 

"Finally, the Artist in no way contributed, caused or was responsible for or to the security considerations, as in those details are and were routinely handled by Quality Control and Shotclock and their production decisions," the lawsuit states. 

Mares is asking for more than $680,000 for medical expenses, loss of income, mental anguish, pain and suffering. The lawsuit stated that he was struck in the neck by a bullet. 

11Alive reached out to the defendants and Mare's attorney for additional information but as of Monday night, have not heard back. On Monday, Atlanta Police confirmed the investigation is ongoing and that no one has been arrested. No motive has been released.
