Grand jury to convene in Barrow County, expected to hear Apalachee High shooting case

Colt Gray, 14, faces four counts of felony murder in the case, with the potential to face numerous other charges.

BARROW COUNTY, Ga. — A grand jury will convene in Barrow County on Thursday, with expectations that it will soon hear the Apalachee High shooting case.

Colt Gray, 14, faces four counts of felony murder in the Sept. 4 school shooting, with the potential to face numerous other charges.

Days after the shooting in September, Piedmont Judicial Circuit District Attorney Brad Smith said more charges would be filed against Colt Gray. He said at that time the grand jury would begin hearing the case on Oct. 17.

Colt Gray's father, Colin Gray, also faces second-degree murder and cruelty to children charges in the case. He was in court on Wednesday for a preliminary hearing on those charges, with a judge determining there was enough probable cause for the case the move forward.

In that hearing, Georgia Bureau of Investigation agents testified that Colt's mother, Marcee Gray, said to them her son had a "fascination with school shooters and school shootings" and that he had access to guns at home. 

At the hearing, GBI Special Agent Kelsey Ward testified that Colt Gray texted both of his parents on the morning of the school shooting.

"At 9:42 a.m. Colt texted Colin again; he stated, 'I'm sorry, it's not your fault. Know I love you," Ward said. "'You're not to blame for any of it.'"

Ward testified that Colt had also texted his mother at 9:50 a.m., "'I'm sorry.'"

Marcee Gray called the school the morning of the shooting waring of an emergency. She has been indicted in an unrelated case and accused of elder abuse for allegedly taping her own mother to a chair in 2023.

Colt Gray's attorneys have previously filed a request for his records with the Division of Family and Children Services (DFCS) to be released.

"Defendant has no desire to conduct a fishing expedition and specifically requests that the Court exclude all information regarding the Defendat's siblings that the Court deems irrelevant," a filing submitted by his attorneys said. "However, it is the Defendant's position that all records pertaining to his parents are relevant and requests that any such records deemed so by the court." 

This week, students at Apalachee High returned from fall break for their first full days of class since the shooting.
